Rental Agreement


During the rental period all items are for rental purposes only and may not be sold or loaned to third parties under any circumstances.

RENTAL APPOINTMENTS:

It is recommended that you contact us 2 - 6 months prior to your production opening date. Please contact us at least 2 business days prior to when you would like to schedule a visit.

ACKNOWLEDGEMENT:

The Customer shall state in any and all its publications that contain The Costume: “Costume(s) by Fairytas. www.fairytas.com” The Customer will provide Fairytas with a copy of or link to the publication.

CARE OF GARMENTS:

The Customer agrees that The Costume shall be used only for the purposes and in the manner for which they were intended. The Costume shall be maintained and returned to Fairytas in the condition in which The Customer received them as enumerated on the Costume Inventory Sheet. If the items are not in the condition stated on the Costume Inventory Sheet when The Customer receives them, The Customer must notify Fairytas immediately. Any damage not reported to Fairytas is presumed to be the responsibility of The Customer.

DO NOT USE STAGE BLOOD NEAR THE COSTUME!

ACTORS SHOULD BE REMINDED TO BE CAREFUL WHEN:

     APPLYING MAKE-UP

     EATING

     DRINKING

SMOKING WHILE WEARING THE COSTUME IS NOT ALLOWED.

ALTERATION GUIDELINES:

The Costumer agrees that The Costume is rented as is. For fitting purposes, minor alterations are allowed but DO NOT use safety pins. Safety pins left in a garment as alterations will damage the fabric. Under no circumstances may a costume be: cut, dyed, painted, distressed, glued, stapled or taped. Do not use iron-ons, stick-ons, glue-ons or staples. Do not cut seam allowances!

Do not cut a hem/train. Do not flame proof The Costume.

Costumes must be returned to original condition, re-hung on original hangers provided and any and all alterations removed before returning to Fairytas.The Customer agrees to pay a restoration fee to be determined by Fairytas based on the costs of restoring The Costume to its original condition including but not limited to material costs and hourly wages.

PICK-UP, RETURN AND SHIPPING OF COSTUMES:

The Customer is solely responsible for the pick-up and return of The Costume to and from Fairytas, and for all related expenses. All costumes are due back at Fairytas on the return date, which is 10 to 15 business days after the final performance date as stated by The Customer.

Upon receipt of a shipment, The Customer should unpack and inventory The Costume. Inform Fairytas immediately of any shipping damage or packing discrepancies. Any damage or loss not reported to Fairytas is presumed to be the responsibility of The Customer.

The Costume shall be returned to Fairytas by appointment except when the items are being shipped, in which case they shall be shipped prepaid and insured for the replacement costs indicated on The Costume Inventory Sheet.

Extreme care must be taken when packing costumes for return shipment. The majority of damages in any costume rental are the result of improper packing.

THE FOLLOWING DIRECTIONS MUST BE ADHERED TO:

     When unpacking, The Customer must take particular note of how items are packed and repack each item in at least the same way.

     The Customer should use the Costume Inventory Sheet as a checklist to ensure that all rented items are returned. Include a copy of the Costume Inventory Sheet in each box and highlight the items that are packed in that box.

     Headwear or breakable items (such as armor or jewelry) should be packed and cushioned in a separate, strong box – not with other costume pieces that might damage them.

     The Costume must never be packed when damp.

PENALTY FOR LATE RETURNS:

All costumes are due to be shipped back to Fairytas before the return date, which is ten 10 to 15 business days after the final performance of the production as stated by The Customer. The Costumer agrees to provide proof of shipment in form of a shipping bill or Track&Trace code to Fairytas. If The Costume is shipped after this date, The Customer will be charged with the determined security deposit, for each week past the return date until Fairytas receives proof of shipment.

LOSS OF AND/OR DAMAGE:

The Customer assumes all responsibility for loss of and/or damage to The Costume entered on the Costume Inventory Sheet for any cause whatsoever. In the case of lost items Fairytas will charge a replacement fee equal to the replacement costs stated on the Costume Inventory Sheet. In the case of damages The Customer agrees to pay a restoration fee to be determined by Fairytas based on the costs of restoring The Costume to its original condition including but not limited to material costs and compensation for time spent on the restoration.

PROOF OF INSURANCE:

Fairytas requires a proof of insurance from The Customer. If the customer is unable to provide an appropriate proof of insurance prior to the shipping/pick-up of The Costume, Fairytas will be unable to accommodate The Costumer rendering this agreement null and void.

REFUNDABLE SECURITY DEPOSIT:

A refundable security deposit of 10% of the total of the replacement costs as indicated on The Costume Inventory Sheet is required for all rentals upon the signing of this agreement. The amount of the refundable security deposit is determined by the size of the rental. Refunds are processed within 10 to 15 business days of the return of the items and the close The Customer’s account.

TERMS OF PAYMENT:

Upon signing the Costume Rental Contract, The Customer agrees to pay all rental and shipping fees prior to the shipping/pick-up of costumes. A final invoice for costs including but not limited to late fees, cleaning, restoration and replacement charges will be sent after the costumes are returned to and inventoried by Fairytas. Any charges on the final invoice will be deducted from the security deposit, and any overcharges will be billed to the Customer. The Customer shall pay Fairytas within 10 business days of receipt of the final invoice. We accept Paypal and international bank transfers. A rental fee refund is processed within 10 to 15 business days of the return of the items and the close of The Customer’s account.

ENFORCEMENT OF AGREEMENT:

If it becomes necessary for Fairytas to employ an attorney to enforce the terms of this Agreement or collect any sum of money due hereunder, The Customer agrees to pay all costs and expenses of collection or enforcement incurred by Fairytas, including but not limited to Fairytas’ reasonable attorney’s fees and costs.

NON-LIABILITY OF FAIRYTAS:

Fairytas is not responsible or liable to The Customer or its employees, independent contractors, and agents for personal injury or death to any person, or property damage occurring on property owned or rented by Fairytas, its employees, independent contractors, and agents.

The Customer agrees to use The Costume or other items specified on the Costume Inventory Sheet at The Customer’s own risk. Fairytas shall not be responsible or liable to The Customer’s or its employees, independent contractors or agents for personal injury or death to any person, or property damage arising out of or in connection with the use of The Costume.

FAIRYTAS WILL SHIP ITEMS ONLY AFTER RECEIPT OF THE FOLLOWING:

     Signed Costume Rental Agreement

     Full Payment and Security Deposit

     Proof of Insurance
